The Eviction Process in South Africa: What Landlords Need to Know

## Understanding the Eviction Process Evictions in South Africa are regulated by the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act (PIE Act). This legislation provides a framework that balances the rights of property owners with the constitutional right to housing. ### When Can You Evict? A landlord may seek an eviction order when: - The lease agreement has expired or been validly cancelled - The tenant has breached the terms of the lease (e.g., non-payment of rent) - The occupier is occupying the property unlawfully ### The Legal Process **Step 1: Notice** The landlord must provide the tenant with written notice to vacate the premises. The notice period is typically determined by the lease agreement or, failing that, by common law (usually one month). **Step 2: Court Application** If the tenant refuses to vacate, the landlord must apply to court for an eviction order. Self-help remedies (such as changing locks or cutting utilities) are illegal. **Step 3: Service of Court Papers** The court application must be served on the occupier and the relevant municipality at least 14 days before the court hearing. **Step 4: Court Hearing** At the hearing, the court will consider: - The circumstances under which the occupier occupied the property - The period of occupation - The availability of alternative accommodation - The rights and needs of the elderly, children, disabled persons, and female-headed households **Step 5: Eviction Order** If the court grants the order, a date will be set for the eviction.
